Terms of service
You pick your friends. We keep the games running.
Version 2026-10-18, in effect from October 18, 2026. This version has been replaced. Read the current terms.
These terms are an agreement between you and Simple Games With Friends ("we", "us"). They cover the Simple Games With Friends app and the website at simplegameswithfriends.com (together, "the service"). By creating an account or using the service, you agree to them. If you don't agree, please don't use the service.
Our privacy policy explains what we collect and why. It is part of these terms.
1. Who can use the service
You must be at least 13 years old to create an account. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. Each account is for one person. You are responsible for keeping your password safe and for what happens on your account. If you think someone else is using it, tell us.
2. You choose who can reach you
The service is built so that you decide who you play with and who can message you:
- Nobody can find you by searching, and there is no public directory or public chat. People connect only through an invite that one of them sends and the other accepts.
- Only people you are connected with can message you: friends you have accepted, players in a match you have joined, and members of a Circle you have joined.
- A Circle is a group you choose to join. When you join one, you agree to play and message with everyone in it, including members who aren't your friends. If you no longer want to be in a Circle, you can leave it at any time.
- You can end a connection at any time. Removing a friend stops new games and direct messages between you. You can also resign or leave a match, and leave a Circle (or, if you own it, remove a member or delete it).
Because you choose your connections and can end any of them whenever you like, you are in control of the messages and games you see. We do not read, screen, or approve messages before they are delivered, and we are not responsible for what other people send you. Each person is responsible for what they send. Whether you join a Circle or stay in one is always your choice. If someone you connected with sends something you don't want, the fastest way to stop it is to remove them as a friend, leave the match, or leave the Circle.
You can also tell us about a problem through the feedback option in the app or by email. We may look into it and act as described in section 4, but we have no obligation to.
3. Your content
The messages you send, your display name, and anything else you put into the service are yours. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, and deliver that content only as needed to run the service: for example, to show your message to the friend you sent it to and keep your game history in sync across your devices. This permission ends when the content is deleted from the service, except for copies kept in backups for up to 30 days or where the law requires us to keep them.
We don't keep games forever. The moves and messages in a match are deleted 90 days after the match ends. We keep its result (which game it was, who played, who won, and when) so your stats stay right, until your account is closed. A match that nobody makes a move in for 30 days ends with no winner. A challenge that ends before anyone plays in it is deleted completely 30 days later. If you want to keep something from a game, save it yourself before then.
You are responsible for the content you send, and you promise that you have the right to send it.
4. Rules for using the service
You agree not to:
- harass, threaten, bully, or impersonate anyone;
- send anything illegal, or content that sexually exploits or endangers minors;
- send spam, or use the service to advertise or sell things;
- try to get into accounts, data, or systems that aren't yours, or interfere with the service or other players;
- cheat by using bots or automation, or by exploiting bugs; or
- copy, resell, or reverse engineer the service, except where the law allows it.
We may remove content, limit features, or suspend or close an account that we believe breaks these terms or puts other people or the service at risk. We may do this without notice, and we are not required to monitor the service or act on every report.
5. A free service, and Plus
The service is currently free. We plan to offer an optional paid membership, Plus, with extra features. If you buy Plus or any other paid feature:
- the price, what's included, and how often you're billed will be shown to you before you buy;
- payments are handled by the app store you buy through (such as Google Play or the Apple App Store), and that store's terms apply to billing, renewals, cancellations, and refunds;
- subscriptions renew automatically until you cancel them in the app store; and
- when a subscription ends, its extra features stop. Your account, friends, and game history stay (as described in section 3), though some things may become limited (for example, how many games a Circle can run at once).
We may change which features are free and which are part of Plus. If we change the price of a subscription you already have, we'll tell you in advance, and the change takes effect from your next renewal.
6. Changes to the service
We are a small team and the service will change. We may add, change, or remove games and features, and we may pause or stop the service, in whole or in part, at any time. If we plan to shut the service down for good, we will try to give you reasonable notice.
7. Changes to these terms
Each version of these terms is named for the date it takes effect. We keep every past version published at simplegameswithfriends.com/terms, and we record which version was in force when you created your account. If we make a change that materially affects you, we will let you know in the app or by email before it takes effect. If you keep using the service after a new version takes effect, you accept it. If you don't, you can stop using the service and close your account.
8. Ending your account
You can stop using the service at any time. To close your account and delete its data, email us at the address below. We may close accounts as described in section 4, or if the service shuts down. Sections 3 (for copies we're allowed to keep), 9, 10, and 11 still apply after your account is closed.
9. No warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise that the service will be available, uninterrupted, secure, or free of errors, or that games, messages, scores, or other data will be kept or won't be lost.
10. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. THIS INCLUDES CONTENT OR CONDUCT OF OTHER USERS, AND MESSAGES OR GAMES FROM PEOPLE YOU CHOSE TO CONNECT WITH. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US$20.
Some places don't allow these limits. Where that's true, they apply only as far as the law allows. Nothing in these terms limits rights you have that can't be waived by contract.
11. Responsibility for your use
If someone makes a claim against us because of content you sent or because you broke these terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
12. General
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms right away, we can still enforce it later. You may not transfer these terms to someone else. We may transfer them if the service changes hands. These terms, with the privacy policy, are the whole agreement between you and us about the service.
These terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-law rules. Any dispute about the service or these terms will be decided in the state or federal courts located in Missouri, and you and we agree to those courts' jurisdiction. If you live outside the United States, this doesn't take away any protection you have under the consumer laws of the country where you live.
